These Terms of Service ("Terms") govern your access to and use of the XCHK identity verification platform ("XCHK," "we," "us," or "our"), operated by Maclawran LLC. By creating an account or using our services, you agree to these Terms.

1. Services

XCHK provides a live video identity verification platform. Our services include:

• Live video verification sessions between helpdesk agents and verification subjects
• Location verification using GPS and IP geolocation
• Device and network authentication including browser language, timezone, and VPN/proxy detection
• Screenshot capture and session recording
• Integration with third-party platforms such as Zendesk
• Automated PASS/FAIL result posting to integrated platforms

2. Account Registration

To use XCHK, you must create an account with accurate and complete information. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. You must notify us immediately of any unauthorized use.

You must be at least 18 years old to create an account.

3. Acceptable Use

You agree not to:

• Use XCHK for any unlawful purpose or in violation of any applicable law or regulation
• Attempt to circumvent or defeat any security or verification measures
• Interfere with or disrupt the platform, servers, or networks connected to XCHK
• Reverse engineer, decompile, or extract the source code of the platform
• Use XCHK to harass, abuse, or harm others
• Resell or redistribute XCHK services without authorization

4. Verification Sessions

When you conduct a verification session on XCHK:

• You are responsible for obtaining any necessary consent from verification subjects before initiating a session.
• You must provide a lawful basis for processing the subject's personal data under applicable data protection laws.
• You agree that XCHK acts as a data processor on your behalf for verification sessions.
• Verification results are provided as a tool to assist your decision-making and do not guarantee the identity or honesty of any individual.

5. Intellectual Property

XCHK, its name, logo, and all related product and service names are trademarks of Maclawran LLC. The platform software, design, and content are protected by copyright and other intellectual property laws. You may not copy, modify, or create derivative works without our permission.

6. Fees and Payment

Fees for XCHK services are set forth in the plan or agreement under which you subscribed. All fees are in U.S. dollars unless otherwise stated. You are responsible for all applicable taxes. We reserve the right to change our fees upon notice.

Payment is processed through Stripe. By providing payment information, you agree to Stripe's terms and authorize us to charge your payment method.

7. Third-Party Integrations

XCHK may integrate with third-party platforms including Zendesk. Your use of such integrations is subject to the terms of both XCHK and the third-party provider. We are not responsible for the availability, accuracy, or practices of third-party platforms.

8. Data and Privacy

Our collection and use of personal data is governed by our Privacy Policy. By using XCHK, you acknowledge that you have read and understood our Privacy Policy.

9. Disclaimer of Warranties

XCHK is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the platform will be uninterrupted, error-free, or completely secure.

10. Limitation of Liability

To the maximum extent permitted by law, Maclawran LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business, arising from your use of XCHK. Our total liability shall not exceed the amount you paid us in the twelve months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless Maclawran LLC, its officers, and employees from any claims, damages, or expenses arising from your use of XCHK, your violation of these Terms, or your violation of any third-party rights.

12. Termination

We may suspend or terminate your account at any time for violation of these Terms or for any other reason at our discretion. You may terminate your account at any time by contacting us. Upon termination, your right to access XCHK will cease. Data retention is governed by our Privacy Policy.

13. Governing Law

These Terms are governed by the laws of the State of Florida and the United States, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved in the courts of Monroe County, Florida.

14. Changes to These Terms

We may modify these Terms from time to time. We will notify account holders of material changes via email or through the platform. Your continued use of XCHK after changes take effect constitutes acceptance of the modified Terms.
